Introduction

Welcome to Frameshop! By using our services, you agree to comply with these Terms and Conditions of Use ("Terms"). Frameshop is a solution that allows you to create an e-commerce store on Framer without coding. These Terms define the rules for using the service and aim to protect both Frameshop and its users.

Frameshop offers users the ability to easily create an online store with a variety of pre-built features without needing programming knowledge. Our mission is to make e-commerce accessible to everyone.

Definitions

Service: All features offered by Frameshop to create an online store, including cart management tools, payment systems, and site customization components.

User: Any person who uses Frameshop, whether an individual or a company wishing to sell products or services online.
Account: Personal space created by a user to access Frameshop's services.
Content: Information, texts, images, products created or published by the user via Frameshop.
Subscription: A subscription to different paid services of Frameshop, allowing access to advanced features and reducing the commission.
Website: The website where Frameshop is accessible, as well as any other interface (API, mobile applications, etc.) allowing the use of Frameshop services.

Eligibility

To use Frameshop, you must be at least 18 years old and capable of entering into a legally binding contract. You are responsible for ensuring that you meet these criteria. If you have any doubts about your ability to enter into a contract, you should not use Frameshop. Frameshop is reserved for users who comply with the laws of their country of residence. You are responsible for complying with local laws and must ensure that you are legally allowed to use our services.

Account Access

To access Frameshop, you can simply log in via Stripe without creating a separate account. Your Stripe account credentials will be used to authenticate your access to the Frameshop services. It is your responsibility to keep your Stripe login credentials confidential. You are solely responsible for any activity that occurs under your Stripe account. If your account is compromised, you must inform Frameshop as soon as possible. Frameshop will not be liable for any loss or damage resulting from your failure to protect your account.

Services Provided

Frameshop provides tools to transform a Framer site into an online store. Our services include, but are not limited to:

Add to Cart Buttons: Allow customers to add items to their shopping cart.
Empty Cart Button: Allows customers to empty their shopping cart.
Checkout Button: Enables customers to proceed to checkout and finalize their purchase.
Cart List Component: Displays all items currently in the customer's shopping cart.
Total Cart Component: Shows the total amount for all items in the shopping cart.
Cart Component: Displays the number of items in the cart and provides easy access to view the cart.
Checkout Systems: Integration with secure payment systems for customers to complete their purchase.

Frameshop reserves the right to modify or limit certain features without notice. We may also add new features or update existing services to improve your user experience.

Frameshop does not guarantee the absence of bugs, errors, or malfunctions in the services offered, and cannot be held responsible for data loss or service interruptions. Frameshop reserves the right to temporarily or permanently suspend access to its services for maintenance, improvement, or any other reason without notice or compensation.

Payment Terms

Frameshop is free to use for all users. However, for the Free plan, a 2% commission is charged on each sale made via our platform. This means that each time a transaction is completed, Frameshop will receive a 2% commission of the total sale amount. Users can opt for paid subscriptions to benefit from additional features and reduce the commission to 1.6%. Subscriptions offer advantages such as access to advanced customization options, priority support, and a reduction in sales commission.

Payment Methods

Available payment methods include credit cards, bank transfers, and other third-party payment options at Frameshop's discretion. All transactions are secure, and payment information is processed in accordance with our Privacy Policy.

Billing and Renewal

Subscriptions are billed on a recurring basis, either monthly or annually, depending on the chosen plan. You can manage your subscription and payment information from your personal account. In case of payment failure, we reserve the right to suspend or terminate your access to paid services. Frameshop is not responsible for any billing errors or technical issues related to payment platforms. You are advised to regularly review your transaction statements and contact us in case of any issues.

Cancellation and Termination

You can cancel your account or subscription at any time by accessing your personal space on the site. In case of cancellation, paid services will remain available until the end of the current billing period, with no prorated refund. Frameshop reserves the right to suspend or terminate your access to the service in case of violation of the Terms, fraudulent use, or behavior that harms the user community. We also reserve the right to take legal action in case of serious violations.

Termination Procedure: To cancel your subscription, you must go to the "My Account" section on our site and follow the instructions. Frameshop will send you a confirmation email once the cancellation has been processed.

Frameshop will not be liable for any loss of revenue, indirect damages, or any other consequence resulting from the suspension or termination of your account.

User Responsibilities

Users must use Frameshop in a legal and respectful manner. You are responsible for the content you publish or create, and it is prohibited to use Frameshop for illegal or harmful purposes. You must not use Frameshop to send unsolicited emails (spam), publish defamatory or illegal content, or violate the intellectual property rights of others.

You are also responsible for the accuracy and truthfulness of the information relating to the products you sell. Frameshop cannot be held responsible in case of disputes between a user and their customers concerning misleading or incorrect information.

By using Frameshop, you agree not to bypass, disable, or compromise the security measures integrated into the service. Any misuse detected may result in the immediate suspension of your account, without notice.

Intellectual Property

Frameshop owns all intellectual property rights related to the services, including but not limited to software, visuals, interfaces, and content. By using Frameshop, you do not receive any ownership rights. You grant us a non-exclusive, worldwide, royalty-free license to use the content you create as part of providing the service.

All logos, trademarks, and other content owned by Frameshop may not be used without prior written permission. Any unauthorized use may result in legal action.

Frameshop is not responsible for any intellectual property rights violations by users. In case of a complaint, we reserve the right to remove the disputed content without notice.

Frameshop is not responsible for the quality of products sold through users' stores or for disputes between users and their customers. Any legal action or claim must be directed against the responsible user.

In no event shall Frameshop's cumulative liability exceed the total amount of commissions collected on a user's sales during the six months preceding the event giving rise to liability.

Indemnification

You agree to indemnify Frameshop, its officers, employees, and partners for any claim, damage, loss, or expense (including reasonable legal fees) resulting from your use of the service, violation of these Terms, or any activity related to your account.

You agree to fully cooperate with Frameshop in the event of a third-party claim. We reserve the right to assume our legal defense, in which case you may not settle the claim without our prior written consent.

Modification of Terms

Frameshop reserves the right to modify the Terms at any time. Users will be informed of changes via the website or by email. It is your responsibility to regularly review the Terms to stay informed of changes. Continuing to use Frameshop constitutes acceptance of the new terms.

Frameshop will not be liable for any loss or damage resulting from a user's refusal of the new terms. Any decision to terminate following a modification of the Terms does not entitle the user to a refund of payments already made.
